Thank you for your interest in my art and for looking at my work / commission page. IMPORTANT UPDATE: As of March 29 2026, I no longer offer client approval after the sketch phase. This change was made to allow for better work overall, not having the flow / process interrupted for extended periods of time. The ToS has been updated to reflect these changes.

terms of service

NOTICE: This is the TOS which applies to all ALL ORDERS from me - including trades, gifts, or otherwise free art. By requesting art from me you are indicating that you have read and agree to these terms of service in their entirity.Below is the CONDENSED version of the TOS. Detailed information may be missing. The sole purpose of this condensed version is for you, as the customer, to have an easy overview of the main points. Please refer to the full TOS below for more detailed terms.

  • Full payment is required up front for orders below $100.

  • The art will be delivered digitally - typically within 4 weeks from the date of payment.

  • I am not responsible for loss of product once it has been delivered.

  • You have the right to two (2) complete revisions in the sketching phase with additional revisions available for reference sheets.

  • All prices are listed in, and must be paid in, USD unless otherwise specified.

  • The art does not come with publishing, commercial, nor sale rights without additional fees.

  • I can cancel and refund any order at any time.

  • You do not hold the right to use the art in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space.

  • You do not hold the right to use the art in any AI-related technology, including submitting for datasets, and any future inventions in the space.

TERMS OF SERVICE
LAST UPDATE: April 14th, 2026


This contract applies to the artist further referred to as "Moth", or other self referential descriptors, and person or institution further called "you", "customer", or any descriptors that refer to the person being addressed purchasing from Moth a work of art further called "art", or "commission". By ordering art from myself, you agree to the following terms and conditions:


PAYMENTS
1. You agree to pay the due amount upfront for any orders of value lower or equal to $100.
2. On orders above $100 you agree that there is the option to, instead, pay half the invoice total upfront. If this option is chosen, the other half has to be paid on approval of the initial sketch.3. Any other payment schedule has to be mutually agreed before work on the art commences.4. You accept that work on the art will not commence until payment has been received by myself according to the above schedule.5. Payment is to be made through Ko-fi, PayPal, or (for Australian residents) direct bank transfer. For payments made through bank transfer, the correct conversion equivalent to of USD at the current exchange rate must be sent. Please see sections under 'Currency Conversion' for further information.

PRODUCT DELIVERY
6. You agree that the art will be delivered digitally through either a download link, direct message, or email address, after the final payment has been received and work has been completed by myself.
7. Any other method of delivery, either digital or physical, has to be mutually agreed before the work commences. You are obliged to bear any costs incurred by alternative delivery method, such as postal costs, material costs, digital service subscription fees etc.8. It is sole responsibility of you to propose delivery method which works for both parties. I cannot be held accountable for your loss of access to the delivery method, loss of delivered files, impediments such as spam filters or any other technical obstacles outside my responsibility.a) Upon delivery of the art, it is your responsibility to store it properly. Loss of the art due to negligence will not be reimbursed by myself. I can not guarantee that the original copy will be available in the case that you loose your files.

REVISIONS
9. All terms under this section titled 'revisions' are fixed and may not be altered after a commission has been purchased except in cases where:
i) you and I have explicitly agreed upon different revision terms and have outlined the specifics of said agreement in writing; or
ii) you have purchased a 'reference sheet'.
10. In cases where a 'reference sheet' has been purchased, more frequent revisions are allowed due to the nature of the work. However, they must still be considered reasonable. For the purposes of a reference sheet, reasonable revision requests are considered to be:
i) made in good faith by yourself; and
ii) made in the sketching stage of the commission where possible; and
iii) must not undo work that was already approved previously; and
iv) does not exceed 5 requests in the sketching stage; or
v) does not exceed 2 requests during further stages such as colouring and lining
11. You have the right to two complete revisions in the sketching phase for all art types excluding reference sheets.12. After approval of the sketch, there are no additional approval stages. The next time you hear from me, in most cases, will be with the completed work. I may, however, reach out and request your input occasionally if needed. Direct input requests from myself do not count towards any revision limits.a) Any revisions or requests past the sketch phase, however minor, will require a prior mutual agreement and will result in a proportional increase of order value. Any such increase will be invoiced separately. Work on any such requests will not commence until the payment for the additional invoice(s) has been received.b) A "revision" for the purposes of these terms does not mean any number of literal exact changes. You may request any number of reasonable changes to your art piece, sent within one message (or other form of contact), and all of those changes are considered one revision. Multiple messages may also remain within the single revision, so long as:
i) they are received within 30 minutes of the first request being sent; and
ii) work on those requested revisions has not started yet.
c) Small back and fourth messages between you and I - such as double checking a single minor detail like eye colour or a line placement - do not count as additional revision requests so long as they are deemed to be reasonable at my own discretion.d) Correcting mistakes that were made by myself in instances where they were clearly visible in the reference material do not incur an additional fee.

CURRENCY CONVERSIONS
13. You agree to pay the total amount specified in United States Dollars (USD).
14. It is your sole responsibility of to bear any currency conversion costs, bank transfer fees, payment provider service fees and any other costs involved in transferring funds to myself.15. Payment is considered as received and completed only when total amount received by myself is equal to the invoice amount in USD.

REFUND POLICY
16. If requested, you will be informed of an approximate turnaround time for your commission to be completed. In most cases, the art will be finished within 4 weeks of payment being made.
a) You have the right to request a full refund if there's been no progress for two consecutive months, or when the commission has not been completed within four months. Refund conditions for commissions which require more work must be agreed separately, before the work commences. These provisions exclude work interruptions caused by unforeseen circumstances such as illness, accident or any other credibly documented reason for interruption of work.17. Refunds are not available for dissatisfaction with the finished art. Art is subjective and each piece is uniquely hand made. No two works will be the same. When commissioning me, you are hiring me for my work and skills as is. All of my work is publicly available to view and it is up to you before purchasing a commission to decide if my style is right for you.18. You agree to contact me in a fast and responsive manner, responding swiftly to any requests for comments, clarifications, opinions, validation of progress etc. Lack of timely communication (within 24 hours) on your behalf will be recognized as approval of all work progress and current state of the art.a) You agree to be clear when approving work by using terms like "approved" or "good to continue". Messages such as a thumbs up emoji or "cool" are not clear messages of approval to move onto the next stage and I will defer back to the prior terms - giving 24 hours - if nothing more is said. This will, understandably, delay the time it takes for the commission to be completed.

PERSONAL AND COMMERCIAL USE
19. The art you receive at any stage of progress is for personal use only. Any use of the art for commercial purposes, reselling it, reproduction or publishing for reasons other than personal purposes have to be approved beforehand by myself. This will require a separate agreement between you and I defining exact conditions and financial implications of such use of the commission.
a) "Personal purposes" may include things like getting the art printed onto a shirt or mug - such as for yourself to use, or a gift for a friend. It can also include having it professionally printed to hang in your own living space. Stickers, just for yourself or a friend, is more than okay too. Distribution or use for a personal small business does not fall within the definition of "personal purposes".20. When sharing the art online for personal purposes - including unfishished stages - credit is appreciated but not required. You, however, must not claim to have made the art yourself. If you so choose to add credit, my main handle is @UmbraeMoth (formerly 'ThembieMoth') although I do use @MottenHunde on select platforms.a) The watermark displaying my name / online handle must not be cropped out, removed, or otherwise rendered illegible. Any other editing of the art is allowed, so long as those edits are made clear when sharing.21. You do not hold the right to use the art in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space.22. In addition, you do not hold the right to use the art for AI datasets or for AI tools and any present or future inventions in the space.

CANCELLATIONS
23. I reserve every right to refuse or cancel any order, under condition of full refund, without giving reason - although I will try do to so where possible.
24. Any disrespectful behaviour will not be tolerated and may result in a cancellation of the order. You will receive full or partial refund depending on amount of work completed. I will have full right to refuse any service to you in the future.25. You may request a change of mind cancellation if:
i) you haven't yet paid: or
ii) if it is less than 12 hours since your payment has been finalised; and
iii) work on the art must not have already been started.
26. If the art is being made as part of a donation, prize, gift, or otherwise something a reasonable person would deem to be a charitable cause, change of mind cancellations are not accepted.

Pets, Animals, Animal-Like OC's, Fantasy Creatures, Memes, Monsters, NSFW (only if the subject passes the Harkness test), Horror, etc.

I WON'T DRAW
Humans, Humanoid Creatures (elves, orcs, & so on), Anthropomorphic Characters*, Long Hair, Some Fetish Content (ask).

*In select cases I may sometimes I may draw anthropomorpic characters. These are typically situations where only the head is visible and they do not carry many human-like features.


Full Colour

This may also include fully detailed / shaded greyscale or sepia tone works. Prices are approximate and may increase with complexity.

Reference Sheet

A fully coloured reference sheet of your character. As standard it includes one full body (nude, ken-doll style), one portrait, a name, colour palette, a simple front + back pattern layout (see top left of bird example) where applicable, and extra additional texts (pronouns, race, and so on).

Lined Sketch

A faster and cheaper commission style. Includes linework, a small selection of red-brown hues, and the option of a highlight feature such as the eyes.You may contact me at a later date and request that your 'lined sketch' commission be coloured as with my main style - just pay the difference.
