terms of service

NOTICE: This is the TOS which applies to all ALL ORDERS from me - including trades, gifts, or otherwise free art. By requesting art from me you are indicating that you have read and agree to these terms of service in their entirity.Below is the CONDENSED version of the TOS. Detailed information may be missing. The sole purpose of this condensed version is for you, as the customer, to have an easy overview of the main points. Please refer to the full TOS below for more detailed terms.

  • Full payment is required up front for orders below $100.

  • Product will be delivered digitally - typically within 4 weeks from the date of payment.

  • I (Moth) am not responsible for loss of product once it has been delivered.

  • Customer has right to three (3) complete revisions in the sketching phase.

  • Customer has right to two (2) edits during each additional phase.

  • All prices are listed in, and must be paid in, USD unless otherwise specified.

  • Customer is required to contact me in a fast and responsive manner - within 24 hours.

  • Products do not come with publishing, commercial, nor sale rights without additional fees.

  • I (Moth) can cancel and refund any order at any time.

  • Customer does not hold the right to use the product in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space.

  • Customer does not hold the right to use the product in any AI-related technology, including submitting for datasets, and any future inventions in the space.

TERMS OF SERVICE
LAST UPDATE: September 14th, 2025
This contract applies to the artist further refered to as "me", "I", "myself", "my", and "Moth" and person or institution further called Customer purchasing from Moth a work of art further called Product. By ordering Product from myself the Customer agrees to the following terms and conditions:PAYMENTS
1. Customer agrees to pay the due amount upfront for any orders of value lower or equal to $100.
2. On orders above $100 customer agrees to pay half the invoice total upfront. The other half has to be paid on approval of the initial sketch.3. Any other payment schedule has to be mutually agreed before work on the Product commences.4. Customer accepts that work on the Product will not commence until payment has been received by myself according to the above schedule.5. Payment is to be made through Ko-fi, PayPal, or (for Australian residents) direct bank transfer. For payments made through bank transfer, the correct conversion equivalent to of USD at the current exchange rate must be sent. Please see Part 11, 12, and 13 for further information.PRODUCT DELIVERY
6. Customer agrees that Product will be delivered digitally through either a download link, direct message, or email address, after the final payment has been received and work has been completed by Moth.
7. Any other method of delivery, either digital or physical, has to be mutually agreed before the work commences. Customer is obliged to bear any costs incurred by alternative delivery method, such as postal costs, material costs, digital service subscription fees etc.8. It is sole responsibility of Customer to propose delivery method which works for both parties. I cannot be held accountable for Customer's loss of access to the delivery method, loss of delivered files, impediments such as spam filters or any other technical obstacles outside my responsibility.8b. Upon delivery of the product, it is the Customer's responsibility to store it properly. Loss of product due to negligence will not be reimbursed by myself. I can not guarantee that the original copy of the product will be available in the case that the Customer lost their files.REVISIONS
9. Customer has the right to three (3) complete revisions in the sketching phase.
10. Customer has right to a two (2) additional edits during each phase thereafter. These stages are lining, colouring, and finishing touches for a total of six (6) additional edit requests after the sketching phase.10b. Any further requests or requests deemed to be unreasonable by myself, however minor, will require a prior mutual agreement and will result in a proportional increase of order value. Any such increase will be invoiced separately. Work on any such excessive requests will not commence until the payment for the additional invoice(s) has been received.10c. An "edit" for the purposes of this TOS does not mean X number of literal exact changes. Rather it means, in this context, X number of messages requesting changes. The Customer may request any number of reasonable changes to their art piece, sent within one message (or other form of contact), and all of those changes are considered one (1) "edit". Multiple messages may also remain within the single edit, so long as they are received within 30 minutes of the first edit request being sent and work on those requested edits has not started yet.10d. Small back and fourth messages between myself and the Customer - such as double checking a single minor detail like eye colour or a line placement - do not count as additional edit requests so long as they are deemed to be reasonable.CURRENCY CONVERSIONS
11. Customer agrees to pay the total amount specified in United States Dollars (USD).
12. It is the sole responsibility of Customer to bear any currency conversion costs, bank transfer fees, payment provider service fees and any other costs involved in transferring funds to Moth.13. Payment is considered as received and completed only when total amount received by myself is equal to the invoice amount in USD.REFUND POLICY
14. If requested, Customer will be informed of an approximate turnaround time for their Product to be completed. In most cases, the Product will be finished within 4 weeks of payment being made.
14b. Customer has right to request a full refund if there's been no progress for two consecutive months, or when Product has not been completed within four months. Refund conditions for commissions which require more work must be agreed separately, before the work commences. These provisions exclude work interruptions caused by unforeseen circumstances such as illness, accident or any other credibly documented reason for interruption of work.15. Refunds are not available for dissatisfaction with the finished Product. Art is subjective and each piece is uniquely hand made. No two works will be the same. When commissioning me, you are hiring me for my work and skills as is. All of my work is publicly available to view and it is up to you before purchasing a commission to decide if my style is right for you.16. Customer obliges to contact Moth in a fast and responsive manner, responding swiftly to any requests for comments, clarifications, opinions, validation of progress etc. Lack of timely communication (within 24 hours) on behalf of Customer will be recognized as implicit approval of all work progress and current state of the Product.16b. Customer agrees to be clear when approving work by using terms like "approved" or "good to continue". Messages such as a thumbs up emoji or "cool" are not clear messages of approval to move onto the next stage and I will defer back to Part 16 - giving 24 hours - if nothing more is said. This will, understandibly, delay the time it takes for the Customer to receive the Product.PERSONAL AND COMMERCIAL USE
17. The Product received by Customer is for personal use. Any use of the Product for commercial purposes, reselling it, reproduction or publishing for reasons other than personal purposes have to be approved beforehand by myself. This will require a separate agreement between Customer and I defining exact conditions and financial implications of such use of the Product.
17b. "Personal purposes" may include things like getting the Product printed onto a shirt or mug - such as for yourself to use, or a gift for a friend. It can also include having it professionally printed to hang in your own living space. Stickers, just for yourself or a friend, is more than okay too. Distribution or use for a personal small business does not fall within the definition of "personal purposes".18. When sharing the Product online for personal purposes - including unfishished stages - credit is appreciated but not required. The Customer , however, must not claim they made the Product themselves. If you so choose to add credit, my main handle is @UmbraeMoth (formerly 'ThembieMoth') although I do use @MottenHunde on select platforms.18b. The watermark displaying my name / online handle must not be cropped out, removed, or otherwise rendered illegible. Any other editing of the Product is allowed, so long as those edits are made clear when sharing.19. The Customer does not hold the right to use the product in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space.20. In addition, the Customer does not hold the right to use the product for AI datasets or for AI tools and any present or future inventions in the space.CANCELLATIONS
21. I reserve every right to refuse or cancel any order, under condition of full refund, without giving reasons to Customer.
22. Any disrespectful behaviour will not be tolerated and may result in a cancellation of the order. Customer will receive full or partial refund depending on amount of work completed. I will have full right to refuse any service to the Customer in the future.23. The Customer may request a change of mind cancellation - outside of the reasons listed under the Refund Policy - if they haven't yet paid or if it is less than 12 hours since their payment has been finalised. In the case of the latter, work on the Product must not have already been started to be eligible. Likewise, Art Trades may not be cancelled if work has already commenced.23b. If the Product is being made as part of a donation, prize, gift, or otherwise something a reasonable person would deem to be a charitable cause, change of mind cancellations are not accepted.

*In select cases I may sometimes I may draw anthropomorpic characters. These are typically situations where only the head is visible and they do not carry many human-like features.

*This is the bare minimum starting price for commercial publishing rights of my art. The actual price will vary depending on a number of factors such as desired use of the art. Please contact me so that we can discuss your business needs, come up with an accurate quote, and a correct contract. All of my commercial rights contracts are life-long, not limited to a few years or months.

Wow gold commissions

If you play World of Warcraft (WoW) on US/OCE servers, you have the option of using the in-game currency known as gold to commission me. While most of the same ToS (see here to read) apply, and the same ordering/work process applies, there are a few key differences between these and my regular commissions.


  • All WoW gold commissions are "pay what you want". This means you can pay as little, or as much, as you would like. The finished piece of artwork will reflect the amount paid.

  • The effort to gold ratio (as I call it) is based approximately on the low-average cost of a WoW token in relation to my usual prices. Unless otherwise discussed, I consider this cost to be ~200k for an equivalent of $20 USD.

  • This means that if you would like to purchase a full colour portrait at 100% of my artistic efforts, as exampled here, the approximate cost in WoW gold would be ~400k. Similarly, a lined sketch portrait would be ~200k. As mentioned though, all WoW gold commissions are "pay what you want". These are not set fees but, rather, an approximate guide as I'm often asked what to roughly pay if you would like X, Y, or Z. You can pay more. You can pay less. It is entirely up to you.

  • Server and faction do not matter, so long are you are able to meet up with me in game. As of 2023, trading has been enabled cross-server. Just let me know which faction you are so that I can log onto my appropriate character to meet you.

  • If our schedules don't line up and you are unable to trade me directly, you will need to find a way to mail the gold to me on the 'Moon Guard' server (US).

  • Full payment is required before I start work on your commission. Payment plans are not available for these type of commissions.

  • In some cases I may also accept direct trades of items as payment. These can include things like battle pets (my preference) or mounts. To see the in-game pets I am missing and may be interested in doing a trade for, click this link and have a browse.

  • Neither WoW gold commissions nor commissions paid for in USD take priority over the other. Each is worked on in the order they are received where possible, regardless of value.

  • WoW gold commissions that are of intentionally low and comedic value will not receive the usual approvals and revisions that are typically offered as part of my process.


How to purchase

If a "pay what you want" WoW gold commission is something that interests you, please fill out my commission application form. It can be found HERE or at the top of the page under 'apply'.Fill it out as intended and feel free to ignore the mentioned USD costs throughout. The form only acts as an easy way for me to keep track of commissions and requests. It isn't official by any means so don't feel stressed as you fill it out in a way that may seem incorrect.When you reach the question that reads 'was there anything else you wanted to mention or include', just remember to include that you would like for this to be a WoW gold commission. That way I won't accidently send you a regular invoice. Again, this isn't an official form so if you write the WoW gold in a different section it's fine. So long as it's there somewhere for me.From there, I will reach out to you and discuss your commission idea (if we haven't already done so) and, if everything is approved, we will organise payment ASAP so that I can get started for you. If you have a particular budget or need help with trying to math the aforementioned effort to gold ratio, that's something we can discuss without issue.As always, if you have any questions please feel free to reach out. Examples

Examples of my work can be found in my gallery. This section below acts as more of an approximate price point guide rather than a display of my work overall. Let's see how much bang can you get for your buck gold!


Images act as approximate examples only. Every commission is unique.

The first artwork is an example of what you may receive at a comedically low price point - almost always done intentionally for funny art. It is typically done in MS paint and finished within minutes. It's good for a laugh if you're having a bad day. Don't expect much.

Example 2 features artwork similar to what you might receive at ~35% of the regular price point. In this case it is a sketch that is has been refined and slightly cleaned up. The details are clear and it is obviously the requested subject but no linework or colouring is done.

Somewhere between ~50% to ~80% of the regular price point (varying on if you requested a lined sketch or full colour piece) you might expect to receive something closer to example 3. Here is where you'll start to receive work that is cleaned up further, fully lined, but not coloured.

The fourth example showcases an artwork that could be received at ~100% or more of the price point. In this case it is a full colour work that has been completed entirely. You may also receive a lined sketch if that is what you have requested. Either way, it will be fully finished to the requested level.
